Rules for using the portal Green Europe Today


I. GENERAL PROVISIONS.

  • The Green Europe Today portal (hereinafter: the “Portal”) is provided by Green Media Solutions Sp. z o.o. with its registered office in Warsaw at ul. Grzybowska 87, 00-844 Warsaw, entered into the National Court Register, Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under the number KRS: 0000922930, with a share capital of PLN 5,000 paid in full.


The portal includes:

  • websites and electronic services provided by Green Media Solutions on its own behalf in the greeneuropetoday.com website and its subdomains;
  • Through the Portal, it is also possible to use websites and electronic services provided by third parties.
  • as part of the Portal, information content on various topics as well as promotional and advertising content regarding products and services of Green Europe Today and / or third parties are presented.
  • as part of the Portal, Portal users can use electronic services enabling them to self-present and disseminate their content, as well as communicate.
  • The use of the Portal is based on these Principles, except where the provisions of these Principles refer to specific regulations.
  • The rules of using the Portal are available to all Portal users at https://greeneuropetoday.com/regulamin
  • The Portal User agrees to use the Portal on the basis of these Principles by using any website, website or electronic service provided on the Portal.
  • The law applicable to all legal relations arising from these Principles is Polish law. Any disputes will be resolved by competent Polish common courts.
  • It should be borne in mind that the costs related to the acquisition and sharing of content on the Green Europe Today Portal are covered primarily from the revenues generated by Green Media Solutions for advertising services provided to advertisers on the Green Europe Today Portal. therefore, Green Media Solutions stipulates that the content made available on the Green Europe Today Portal may be presented together with advertisements.


II. RULES OF USING THE INDIVIDUAL INTERNET SERVICES AND ELECTRONIC SERVICES AVAILABLE ON THE PORTAL.

  • The use of individual websites or electronic services provided by Green Media Solutions on the Portal may be based on specific regulations, in particular relevant regulations, price lists, notes containing data and information about the subject, scope and parameters of these websites or services.
  • The User is informed and gets acquainted with the specific regulations mentioned in the previous point of these Rules on the Portal’s websites intended for the provision of websites or services specified in point II.1 above, in particular when using these websites or services for the first time.
  • to the extent to which specific regulations apply, these Principles shall not apply.

III. PROTECTION OF COPYRIGHT AND OTHER RIGHTS.

  • All rights to the Portal and all its elements (including software, functional layout, graphic elements, databases and works presented on the Portal), with the exception of content from and distributed by the Portal users, belong to Green Media Solutions and / or entities cooperating with Green Media Solutions and are subject to legal protection. The portal and individual websites are available as a whole and as a whole they constitute a work to which all rights belong to Green Media Solutions. Green Media Solutions takes the necessary technological and legal measures to protect the integrity of the Portal, control the use of the Portal and individual websites, aimed at limiting the use of the Portal in a way that may interfere with its operation. from the Portal, including the use of the Portal with the omission of individual information, promotional and advertising content, i.e. the fact of downloading the Portal’s websites or individual websites, disregarding the individual content of these websites. Downloading the Portal using web browsers is possible only in a way that does not infringe the rights of Green Media Solutions. Using the Portal in a way that violates its integrity is prohibited.
  • The reservation referred to in section III.1 above applies in particular to:
  • works subject to protection under the Act of February 4, 1994 on Copyright and Related Rights (i.e. Journal of Laws of 2006, No. 90, item 631, as amended), in particular: literary, journalistic , scientific, cartographic, computer programs, art, photography, industrial design, architectural, architectural and urban planning, town planning, music, word-music, stage, stage and music, choreography, pantomime, audiovisual (including film) and others;
  • databases subject to protection under the Act of 27 July 2001 on the protection of databases (Journal of Laws No. 128, item 1402, as amended);
  • trademarks subject to protection under the Industrial Property Law of June 30, 2000 (i.e. Journal of Laws of 2003, No. 119, item 1117, as amended);
  • Internet domain names;
  • other content and services subject to protection under the relevant provisions, including the Act of April 16, 1993 on Combating Unfair Competition (i.e. Journal of Laws of 2003, No. 153, item 1503, as amended) .
  • Using the Portal does not constitute the acquisition of any rights to the Portal or its individual elements. especially:
  • Portal users may use elements of the Portal (including works and databases made available on the Portal) only for their own personal use, unless their use to a greater extent is allowed by applicable regulations or the express consent of Green Media Solutions (possibly other authorized entities);
  • except for the cases specified in point III.3.a) above, without the express consent of Green Media Solutions (or another authorized entity), in particular, it is forbidden to take the following actions in relation to the Portal, its individual parts and the content presented on the Portal:
  • (i) in terms of recording and reproducing content – producing copies of any content using a specific technique, including printing, reprographic, magnetic recording and digital technology;
  • (ii) in the scope of trading in the original or copies on which the content has been recorded – marketing, lending or renting the original or copies;
  • (iii) in the scope of disseminating content in a manner other than specified above – public performance, exhibition, display, reproduction as well as broadcasting and rebroadcasting, as well as public sharing of the work in such a way that everyone can have access to it at a place and time chosen by them ;
  • (iv) in relation to computer programs: the permanent or temporary reproduction of a computer program in whole or in part by any means and in any form; translation, adaptation, rearrangement or any other changes to the computer program; dissemination, including loan or lease, of a computer program or a copy thereof;
  • (v) with regard to databases: extracting the contents of databases and their re-use in whole or in a significant – in terms of quality or quantity – part.
  • for the avoidance of doubt, irrespective of other provisions contained in these “Principles”, Green Media Solutions reserves that without its consent, it is forbidden to further disseminate content from the Portal, including current articles on ecology, economic or social matters, in particular in text form, text and graphics, as well as text combined with a set (“gallery”) of photos.
  • A person who would like to use the content (in particular works) made available on the Portal to a greater extent than indicated in point III.3 of these Principles or has doubts as to the permissible scope of use of this content (including works), should contact Green Media Solutions .
  • Modifying or blocking, without the consent of Green Media Solutions, the content presented on the Green Europe Today Portal may constitute a violation of applicable regulations, as well as the rights of Green Media Solutions or other persons. This applies in particular to the use of tools for this purpose, such as web browsers or other applications, which can modify or block the content provided on the Green Europe Today Portal, including advertising content.

IV. PRIVACY PROTECTION AND PERSONAL DATA PROTECTION.

  • Risks related to the use of the Internet and the function and purpose of software or data that are not a component of the content of websites or electronic services provided on the Portal are provided by Green Europe Today in the Privacy Policy.   • In addition, the rules for the processing of personal data of Portal users are set out in a special regulation listed in point II of these Rules, regarding individual websites and electronic services made available on the Portal.
  • Green Media Solutions reserves the right to share the data of the Portal user and the data of the legal representative or legal guardian of the Portal user, as well as content from and disseminated on the Portal by users, if the obligation to disclose to authorized persons results from applicable law.

V. TECHNICAL REQUIREMENTS NECESSARY FOR COOPERATION WITH THE INFORMATION SYSTEM USED BY GREEN EUROPE TODAY.

  • Green Media Solutions makes every effort to ensure that the use of the Green Europe Today Portal is possible for users of all popular web browsers, operating systems, computer types and Internet connection types. However, Green Media Solutions does not guarantee and is not responsible for the fact that any combination of these factors enables the use of the Portal or its individual elements, in particular electronic services made available on the Portal.
  • The minimum technical requirements enabling the user to use the Portal are a web browser (preferably IE 6.0 or higher versions or a browser based on the Mozilla 1.0 engine or higher). However, the possibility of using individual websites or electronic services available on the Portal may depend on making specific configurations of the Portal user’s computer and meeting other technical requirements, about which the Portal user is informed in the specific regulations set out in point II of these Rules and / or on the websites. VI. FEES FOR USING THE PORTAL.

  • using the Portal may involve fees for the Portal user to third parties for accessing the Internet and data transmission, for which Green Media Solutions is not responsible; Moreover, these fees are not charged by Green Media Solutions and do not constitute remuneration for Green Media Solutions for using the Portal;
  • Green Media Solutions is not responsible for fees for using websites and electronic services provided by third parties, which can be accessed through the Portal; Moreover, these fees are not charged by Green Media Solutions.

VII. USERS ‘RIGHTS AND OBLIGATIONS.

  • When using the Portal, Portal users are obliged to comply with the law and the provisions of these Principles and the specific regulations set out in point II of these Principles, as well as the principles of social coexistence and good manners.
  • It is forbidden for users to provide the Portal with illegal content.
  • Green Media Solutions is entitled to cease providing the Portal or its individual elements for the Portal user in the event of:
  • a) violation by the Portal user of the provisions of the law, the provisions of these Principles, special provisions set out in point II of these Principles, the principles of social coexistence or good manners;
  • b) if the Portal user acts to the detriment of Green Media Solutions or other Portal users or other people;
  • c) in the cases specified in the special regulations specified in point II of these Principles.

VIII. GREEN MEDIA SOLUTIONS LIABILITY.

  • Green Media Solutions does not guarantee uninterrupted and uninterrupted availability of the Portal (or its individual parts) to all Portal users. Green Media Solutions is entitled to interruptions or disruptions in the availability and use of the Portal, in particular when it is caused by:
  • a) the necessity to repair, extend, modify or maintain hardware or software;
  • b) reasons beyond the control of Green Media Solutions (force majeure, acts or omissions of third parties).
  • Green Media Solutions makes every effort to ensure that the information provided by Green Europe Today on the Portal’s websites is accurate, complete, truthful and up-to-date. However, Green Media Solutions cannot guarantee that any information meets these conditions and that it can be used for any purpose by the Portal user. Therefore, we reserve that Green Media Solutions is not responsible for the consequences of using the information contained on the Portal’s websites and for information from persons other than Green Media Solutions (in particular from the Portal users themselves or from persons specified in section I.3 of these Rules).
  • The Portal’s websites contain links (connections) to websites that allow the use of websites and electronic services that are not made available and provided by Green Media Solutions. We make every effort to eliminate links to websites containing content contrary to applicable law, however, we cannot guarantee that this always happens, because we cannot take responsibility for the current content of websites over which, due to the specificity of electronic services and the possibility of the posting of website content by various people (including the Portal users themselves), we have no control. therefore, Green Media Solutions declares that:
  • Portal users use websites and electronic services run by entities other than Green Media Solutions, solely at their own risk;
  • these Principles do not apply to websites and electronic services provided by entities other than Green Media Solutions; in this case, the rules for the use of websites and / or electronic services specified by the entities that provide them apply.
  • Green Media Solutions shall not be liable for the content of advertisements posted on the Portal and for any content from and disseminated on the Portal by persons other than Green Media Solutions (in particular, content from and disseminated by the Portal users themselves). The provision by Green Media Solutions of the possibility of posting and disseminating the content indicated in the previous sentence is limited only to providing technical solutions.
  • Regardless of other reservations, in the case of websites and electronic services made available on the Portal by Green Media Solutions free of charge, Green Media Solutions shall not be liable for lost profits incurred by the Portal users in connection with the use of these websites or services.

Green Media Solutions is also responsible in the cases referred to in this point, if liability results from applicable law.
  • Green Media Solutions shall not be liable for damages caused by the actions or omissions of the Portal users, in particular for their use of the Portal in a manner inconsistent with applicable law or these Principles or specific regulations set out in point II of these Principles and damages resulting from providing incomplete or false data.
  • Green Media Solutions is not responsible for data loss caused by a failure of hardware, software or circumstances beyond the control of Green Media Solutions.
  • Green Media Solutions is not responsible for the content received and sent by the Portal users via the Internet.
    11.When it is justified by technical reasons, Green Media Solutions does not guarantee that the Green Europe Today Portal will be made available (in whole or in part) to persons who, without the consent of Green Media Solutions, modify or block the content presented on the Green Europe Today Portal (in in particular by means of tools such as web browsers or other applications).

IX. CHANGES IN THE RULES OF USING THE PORTAL.

  • These Terms of Use of the Green Europe Today Portal enter into force on the day they are published on the website specified in section I.7 of these Terms.
  • Green Media Solutions reserves the right to change these Rules at any time. Amendments to these Rules enter into force and are binding on the users of the Portal upon their publication (in particular by publishing the content of this Policy containing the changes) on the website specified in section I.7 of these Rules, unless otherwise provided.
  • The Portal User is obliged to read the changes to these Rules on an ongoing basis.

X. CHANGES TO WEBSITES AND ELECTRONIC SERVICES.

  • Subject to the provisions of special regulations set out in point II of these Rules, Green Media Solutions reserves the right to change or discontinue the provision of websites made available on the Portal, resign from providing electronic services or introduce changes to these services, as well as introduce new websites or electronic services. on the Portal, at any time.
  • Subject to the provisions of special regulations set out in point II of these Principles, Green Media Solutions may inform the Portal users about changes or ceasing to provide websites or electronic services, in particular by posting an appropriate statement from Green Media Solutions on the Portal’s websites.

XI. COMPLAINTS and CORRESPONDENCE.

  • The Portal User and the legal representative or legal guardian of the Portal user who do not have legal capacity should direct all correspondence and complaints on matters related to the use of the Portal via the e-mail address: contact@greeneuropetoday.com, provided that the provisions of special regulations specified in point II of these Principles do not state otherwise.
  • Unless the provisions of special regulations set out in point II of these Principles provide otherwise, Green Media Solutions considers complaints within 7 working days of receipt of the complaint, but this period may be extended by a maximum of another 14 working days if the examination of the complaint requires a longer period of time. time. Green Media Solutions will inform the Portal user about the extension of the complaint examination period, indicating the period for which the complaint will be extended and the reason for the extension. Information about the extension of the examination of the complaint and its reason will be provided to the Portal user before the expiry of the seven-day period referred to in the first sentence of this section of the Rules. in the event that the submitted complaint contains deficiencies that prevent its consideration, Green Media Solutions, if it deems it necessary for the proper consideration of the complaint, immediately calls the claimant to supplement it, specifying a deadline, not shorter than 7 working days and the scope of this supplement, with instruction that failure to complete the complaint within the specified period will result in the complaint not being considered. After the expiry of the designated deadline, the complaint shall not be considered.
  • Correspondence related to the use of the Portal and responses to complaints are sent by Green Media Solutions to the e-mail address provided to it by the Portal user, and in the case of the Portal user without legal capacity, additionally to the e-mail address provided to it by the legal representative or legal guardian of such a user.
